These Terms of Service (“Terms”) are a legally binding agreement between you and JKLN, operated by:

1. Acceptance of Terms

By accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our [Privacy Policy].
If you do not agree, you may not use the Service.

These Terms apply to all websites and services operated under the names JKLN, Magmatic Records, and Label 828, including all online stores, digital content, and membership platforms provided or branded under these names.

Certain features of the Service are facilitated by Fourthwall, a third-party platform that may have additional terms and privacy policies that apply to users. You agree to comply with Fourthwall’s Terms of Service where applicable: Fourthwall Terms.

2. Overview of the Service

Through our websites, we offer physical merchandise, digital products (such as music downloads, digital art, and memberships), and music-related services (“Products”).

Some transactions, including payments, shipping, and membership management, are processed via Fourthwall. By purchasing Products or subscribing to Memberships, you agree to abide by both these Terms and Fourthwall’s Terms of Service where relevant.

3. Eligibility

You must be at least 16 years old to use the Service (as required under Article 8 GDPR).
By using the Service, you confirm that:

  • (a) you are at least 16 years old;

  • (b) you have not been suspended or removed from the Service; and

  • (c) your use complies with all applicable laws and regulations.

If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

4. Accounts and Registration

Some areas or features of the Service require an account.
You agree to:

  • provide accurate and complete information,

  • keep your information updated, and

  • maintain the confidentiality of your account credentials.

You are responsible for all activities under your account.

Accounts and personal data may also be managed through Fourthwall, whose privacy and security measures you acknowledge and accept.

5. Prices, Payment, and Fourthwall Services

All prices are listed in Euros (€) and include applicable VAT (Mehrwertsteuer), unless otherwise stated.

5.1 Payment Processing

Payments for Products and Memberships are processed by Fourthwall and/or its payment partners.
By purchasing a Product or Membership, you authorize Fourthwall to charge the total amount due via the payment method you provide.

5.2 Price Changes

We may adjust prices at any time. Such changes will not affect purchases that have already been completed.

5.3 Recurring Payments (Memberships)

Some Memberships renew automatically. You can cancel a Membership at any time before the next billing date via your account settings on our website or by contacting info@magmaticrecords.com.
Cancellation may also require actions on Fourthwall’s platform to stop recurring billing.

By using Memberships or any subscription-based services, you acknowledge that Fourthwall’s billing and account management rules apply.

6. Shipping, Returns, and Withdrawal Rights (Widerrufsrecht)

6.1 Shipping

Physical Products are shipped within Germany, the EU, and selected international destinations.
Shipping costs, carriers, and estimated delivery times are displayed before checkout and may be fulfilled by Fourthwall.

6.2 Withdrawal Rights for Consumers (EU Law)

If you are a consumer under EU law, you have the right to withdraw from your purchase within 14 days without giving any reason, as provided under §§ 355–357 BGB.

To exercise your right of withdrawal, please email info@magmaticrecords.com and include your order number and details.
You must return any physical goods within 14 days of notifying us.
You are responsible for return shipping costs, unless the item is defective or incorrect.

6.3 Exceptions

The right of withdrawal does not apply to:

  • digital products that have already been downloaded or accessed after giving consent to immediate fulfillment and waiving the withdrawal period;

  • custom-made or personalized items.

6.4 Refunds

Refunds will be processed via the same payment method used for your purchase, either by us or through Fourthwall, within 14 days after receipt of the returned goods or valid cancellation notice.

7. Intellectual Property

All content available on the Service—including music, artwork, text, design, images, videos, and software—is the property of JKLN, Magmatic Records, Label 828, or their respective licensors and is protected by German and EU copyright and trademark law.

You may not copy, reproduce, distribute, modify, or publicly display any materials from the Service without prior written consent, except as allowed by applicable law.

8. Prohibited Conduct

You agree not to:

  • use the Service for unlawful purposes;

  • infringe intellectual property or privacy rights;

  • distribute malware, spam, or other harmful code;

  • attempt unauthorized access to the Service or other users’ accounts;

  • impersonate another person or misrepresent your identity;

  • interfere with or disrupt the Service, or servers managed by Fourthwall.

Violation of these terms may result in account suspension or termination.

9. Modifications and Termination

We may modify or update these Terms at any time to reflect changes in our business, legal obligations, or technical developments.
Updates will be posted on this page with a new “Last Updated” date.
Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.

You may terminate your account at any time by contacting info@magmaticrecords.com.
Termination may require cancellation of recurring payments through Fourthwall.

10. Liability and Warranty

The Service and its contents are provided on an “as is” and “as available” basis.
We make no guarantees regarding uninterrupted availability or freedom from technical errors.

To the extent permitted by law, we exclude liability for minor negligence.
However, nothing in these Terms excludes or limits liability for:

  • intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit);

  • injury to life, body, or health; or

  • breaches of essential contractual obligations (Kardinalpflichten).

Your statutory consumer rights remain unaffected.

11. Indemnification

You agree to indemnify and hold harmless JKLN, Magmatic Records, Label 828, and their owners, affiliates, and representatives from any third-party claims, damages, or expenses arising from your unlawful or negligent use of the Service, unless such damage results from our own fault.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules.

If you are a consumer, you may bring legal action in your local court of residence.
If you are a business, the exclusive place of jurisdiction is Hamburg, Germany.

13. Privacy

Your personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and our [Privacy Policy].

Some personal data may also be processed by Fourthwall for payment, shipping, and account management. By using our Service, you consent to such processing under both our Privacy Policy and Fourthwall’s privacy rules.
